Premier Lanka Voyages,

Premier Lanka Voyages is a division of Maribel Investment Holdings (Pty) Ltd, Australia, a specialist travel organisers who focus specifically for in-bound travelers into Sri Lanka. Our business operates out of Sri Lanka and through our other overseas operations. Our services are as advertised.

 

TERMS & CONDITIONS and PAYMENT POLICY

The services provided by Premier Lanka Voyages are subject to the following terms and conditions. The term “Services” refers to any one or more of the following; (a) Transport and car hire (b) Accommodation (c) Activities (d) Excursions. (e) Other tourist services.

These terms and conditions, together with any additional terms that may be set out in the Inquiry / Registration / Booking Form and any further terms and conditions notified to you by us prior to your entering into a contract with us, including any terms and conditions in our website which are relevant to your booking and any other terms which we both otherwise agree will be binding on Premier Lanka Voyages and you once a contract is made between us (Our Terms). A contract will exist between us once you have made your booking with us, paid your deposit (or such other fee as may be appropriate, for example where you are making a ‘late booking’) and we have issued you with our booking confirmation. You should read these terms and conditions carefully.

Governing Law

The contract between us will be governed by Sri Lanka Law and any dispute will be resolved exclusively by Sri Lanka Law and in the courts in Sri Lanka. This contract and all services provided by Premier Lanka Voyages are exclusively governed by Sri Lanka law.

  1. Your Reservation and booking.
    1. Booking details must be completed personally by the traveller or by one person of the age of 18 years and over on behalf of a group who is deemed authorised by individual members (the “Client”) of the Group to contract on their behalf.
    2. Premier Lanka Voyages will confirm the arrangements requested by the Client through web bookings as soon as reasonably possible upon receipt of the Booking details. Please note that for legal purpose, the contract comes into existence when you have made a booking with us, paid your deposit or such other fee as appropriate, for example where you are making a late booking. Despite our best efforts, as services are obtained from third party suppliers, it may not be possible to confirm certain arrangements promptly (e.g. when a hotel is only available on request). Where so specified the legal contract for the services concerned will be formed once we have specifically confirmed those services have been booked even if a previous interim confirmation has been issued.
    3. The Client is responsible for checking the details of the confirmation booking and invoice and should inform Premier Lanka Voyages immediately of any inaccurate information thereto.
  2. Your Contract.
    1. The Client acknowledges that although the Contract is with Premier Lanka Voyages, unless otherwise specified, all services are provided by third party service provider (e.g. hotels, bus operations, car hire, tours, excursions, activities and tailor made services) and that whilst every effort has been made by Premier Lanka Voyages to ensure that such services are safe, it is unable to accept responsibility for third party services out of its control. Premier Lanka Voyages contracts as named ‘agent’ only.
    2. The Client specifically acknowledges that all arrangements made by Premier Lanka Voyages for hotel accommodation, sightseeing tours and services, entertainment, transportation by domestic airlines and helicopter services, railroad, motor bus, automobile and car hire, or boat and/or any other services, that Premier Lanka Voyages acts only in the capacity of an ‘agent’ for the domestic airlines, hotels, and other suppliers for the Services described in the tour arrangements.
    3. In particular the Client acknowledges that because Premier Lanka Voyages maintains no management control over the personnel, equipment, or operations of these Services suppliers, Premier Lanka Voyages cannot assume responsibility for and be held liable for any personal injury, property damage or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason of (1) any wrongful, negligent, or unauthorized acts or omissions on the part of any of the suppliers, (2) any wrongful, negligent, or unauthorized acts or omissions on the part of any employee of any of these suppliers, (3) any defect in or failure of any vehicle, equipment, or instrument owned, operated or otherwise used by any of these suppliers, or (4) any wrongful or negligent acts or omissions on the part of any other party not under the supervision and control, direct or otherwise of Premier Lanka Voyages.
    4. The relevant suppliers’ terms and conditions will be available upon request and from the supplier.
  3. Payment.
    You will be notified at the time of booking of the price of your holiday. You will be required at the time of booking to pay us a non-refundable deposit, typically 30% of the quoted holiday price, and the full holiday price of a booking should be finalised at least 90 days prior to departure. In the event of you requiring to pay the whole holiday price immediately, we will accommodate your request. Additionally, after you having paid your initial 30% deposit, we can accommodate installment payments for the remaining balance of the invoice value which will need to be finalised and settled no later than 90 days before your departure. In certain circumstances (depending on the nature of the booking) we will require a non-refundable deposit in excess of the usual 30%. On occasions, our suppliers require additional amounts up to full payment in advance (for example for Christmas & New Year bookings or other events that are highly sought after). On these occasions we will require additional payment in advance. Unless you are making a late booking, the balance owing must be paid to us no later than 90 days before your date of departure. If we do not receive the balance by this time then we will treat the booking as cancelled by you and you will be liable to pay our cancellation charges and other 3rd party service provider cancellation costs (Refer to Premier Lanka Voyages cancellation charges below). In any event, notwithstanding anything to the contrary contained herein or in any other booking document Premier Lanka Voyages is under no obligation to provide any Services until payment in full has been received therefore as specified in the payment confirmation or as instructed in the confirmation email prior commencement of the tour. Premier Lanka Voyages reserves the right to cancel the tour, and/or apply cancellation charges if payment is not made within the 90 day said period.We accept bank transfers and other forms of payment. However, due to a cost levied on us by the banks, the client will absorb such bank costs. If your booking is made so close to the departure date that it is necessary to issue your documents and itinerary on departure or send them to you by special delivery or urgent email, there will be an administration charge payable by you of £60/Euro79/US$80/Aus$105 per booking, these costs may change from time to time. An administration charge also applies to any changes carried out by us at your request.
  4. Prices.
    The prices quoted or on our website or in our publicity and promotions from time to time are correct at the time of publication. In the event of any change in our prices to those stated we will notify you prior to accepting your booking. All our prices can be quoted in either Euro / US$ or GBP £ Sterling. Prices having been confirmed to you and until such time as payment for your holiday has been received in full by Premier Lanka Voyages, you will be liable to any rates of exchange fluctuations and any increases in your holiday booking that will need to be paid by you prior to your departure to Sri Lanka.(a) Packages
    We guarantee the price of your holiday upon receipt of full payment. We may however pass  on to you certain additional charges resulting from increased transportation costs (including the cost of fuel), dues, taxes, landing taxes or embarkation or disembarkation fees at ports and airports or fluctuations in the exchange rate. We will not pass on any such charges occurring within 30 days of your scheduled date of departure nor which would result in an increase of less than 1% in the total cost of your holiday.(b) Other holiday arrangements
    We reserve the right to pass on any charges levied on us from time to time by our suppliers in respect of any other holiday arrangements made by us on your behalf:

    • Return transportation costs including luggage allowance as confirmed
    • Transfers/transportation/car hire
    • Accommodation, meals
    • The services of a representative, tour guide or an appointed local agent, including a 24-hour emergency contact
    • All Sri Lanka departure taxes, fees and passenger charges
    • Child discounts

    Our holiday price does not include:

    • Visa fees, tickets from clients port/airport of embarkation to Sri Lanka Colombo airport, overseas airport departure charges payable locally, porterage, personal expenditure, hotel extras, fuel and extras for car hire.
    • Taxes or compulsory charges introduced by Governments, regulatory bodies or airlines after you have booked
    • Security charges introduced or increased after you have booked relating to transportation costs
    • Holiday insurance

    The price payable by you for your holiday and what this price includes will be confirmed to you by us at the time of booking and set out in our booking confirmation.

  5. Booking Conditions
    All holidays are subject to availability. When you make a booking with us you are making an offer to us to buy some of our advertised services. We reserve the right to refuse to accept and/or not to proceed with any booking at any time in our sole discretion. Once the contract is    made between us we will use reasonable and best endeavor skill and care to perform our obligations to you in accordance with our Terms & Conditions.All bookings must be made by a person aged eighteen years or over. Where your booking is for more than one person, the first-named person in your party aged eighteen years or over will be treated by us as the ‘lead name’ for your booking. The lead name will be responsible for making all payments due to us in accordance with our contract.Completion and submission by you of our Booking Form will be treated by us as confirmation that you have read, understood and accepted all our Terms & Conditions and that you are financially responsible for such booking and all information supplied by you in using this website is true and accurate.It is important that you accurately complete our booking form as all documents, notices and other information relating to your holiday will generally be based upon this and sent to the informed address. It is your responsibility to ensure that the details which you supply to us are correct.
  1. Amendments to the Itinerary by the Passenger
    Post confirmation, if the Client wishes to change the dates or nature of Services, an application to do so may be made to Premier Lanka Voyages and Premier Lanka Voyages shall endeavour to accommodate such changes at the least cost to the Client. The Client shall be responsible for all extra costs of such change.No credits or refunds for unused services shall be given if the Client fails to avail him/herself of the confirmed tour arrangements.
  1. Cancellation by the Passenger
    Any Client may cancel the tour arrangements at any time by using the same email address that was used for confirmation. Written notification from the person who signed the booking form must be received by Premier Lanka Voyages for such cancellation and cancellation charges will apply.
  1. Changes to the Itinerary by Premier Lanka Voyages
    Premier Lanka Voyages reserve the right to make occasional changes at any time. Most of these changes may relate and be the result of flight arrival timings and carrier delays at Colombo airport. Premier Lanka Voyages undertakes to inform the Client at the earliest opportunity of such changes. Premier Lanka Voyages cannot under any circumstances accept any responsibility for any expenses or costs the Client may incur as a result of a change which is beyond Premier Lanka Voyages reasonable control.
  1. Cancellation charges
    Based on a Number of days left before your due date of departure when your authority in writing is received by us. Cancellation charge (expressed as a percentage of the total holiday price) will be applied.
    90 days or more – Deposit only 30%
    89 – 43 days 40 %
    29 – 42 days 60 %
    7 – 28 days 90 %
    14 days or less 100 %
  1. If we have to change or cancel your holiday
    We will take reasonable care to deliver the holiday which we are contracted to provide to you. As we put in place the arrangements necessary to enable us to offer our range of holidays many months in advance, we may occasionally have to make changes and reserve the right to do so at any time.
  1. Circumstances beyond our control
    We will not pay compensation or accept any liability where any change is due to circumstances outside of our reasonable control, including (without limitation) any strikes, lock-outs or other industrial action; labour disputes; acts of God; war; riot; civil commotion; malicious damage; compliance with any law or governmental order, rule regulation or direction; impossibility of the use of any means of public or private transport or any action of any government or regulatory body; accident; break-down of plant and machinery; fire; flood or storm; other adverse weather conditions (including heavy rainfall, hail, snow, fog or frost) affecting any airport, port or any other transport link, embarkation or disembarkation point and their operation; flight delays; other matters affecting air traffic control (including failure of equipment, systems and software); siege; acts of terrorism; police or security alerts or precautionary measures taken.Our suppliers and our local representatives are instructed not to act as our agents in booking any alternative activities other than those approved and offered by us and which you have purchased directly from us. Any assistance they may offer at your request in relation to such activities does not imply they have acted as our agent or with our authority or approval. We are not responsible for such activities and have no liability to you in respect of any of them.
  1. Special requirements
    If you have any special requirements (dietary or medical or otherwise) you must inform us of these at the time of booking so that we can pass these onto our suppliers. We cannot guarantee that your requirements will be met, however, and we are not liable to you in the event that your wishes are not met.
  1. Your responsibility
    (a) It is your responsibility to ensure that you and everyone travelling with you have valid passports, appropriate visas and vaccinations and immigration requirements. Some countries may require your passport to have two blank pages for a visa stamp.(b) You are responsible for ensuring that any existing medical conditions or disabilities which may require assistance are declared to us before you book your holiday or, if newly diagnosed, before your due date of departure so that we can pass these details on to our suppliers in good time. We are not in any circumstances liable if any carrier refuses you or any member of your party as a passenger as a result of any medical condition or disability. The Client is responsible for consequences of illness and/or accidents and must pay possible expenses to doctors, hospitals, ambulances and special transports and associated services. It is your responsibility to have adequate medical insurance for such eventualities.(c) You are responsible for your behaviour and that of your party. We and our suppliers  reserve the right to refuse your booking or the right to travel and to remove you and/or any member of your party from any transport, accommodation or any part of holiday if you or any member of your party is drunk or under the influence of drink or drugs or abusive; if you are or we reasonably believe that you are in unlawful possession of drugs; or are behaving violently, disruptively, dangerously or irresponsibly or in any manner whatsoever which   presents a risk to others or is causing a nuisance or annoyance to others. No refund will be given or compensation paid and no costs or expenses for which you become liable or which are incurred by you will be made by us or be recoverable by you from us in such circumstances.You may also become the subject of police inquiry or security measures or investigation and liable in the event that any offence is committed to criminal prosecution and penalties whether in at the port/airport of embarkation or in any other country having jurisdiction in respect of the alleged activity.You must fully cooperate with and follow any safety procedures and instructions given by any organisation which is running the activities which you do while on holiday. It is possible that such organisations will require you to sign a waiver form in respect of the activity being carried out. Premier Lanka Voyages will not be held liable or responsible for any accidents, injuries that the Client may sustain during such activity(s). The Clients take responsibility for their own behaviour and will reimburse Premier Lanka Voyages or its suppliers for any damage caused by negligent or reckless behaviour by the Client or due to circumstances within the Clients control.

    (d) Despite our best endeavours to ensure your holiday runs as smoothly as possible, problems can occur. If you do experience difficulties that cannot be dealt with at the time by the hotel, lodge or camp and/or any place that you are staying at that Premier Lanka Voyages have booked for you, then please contact (where applicable) our local representatives. If they cannot be reached, please contact us on our 24-hour emergency number (+94(0)787179764). Please remember that we will be unable to help, if you only notify us of the issue upon your return home from holiday. If you have a medical emergency, you must notify your travel insurance providers on their 24-hour emergency telephone number (which should be visible on your insurance cover note). If you cannot make contact, please ring us and we will attempt to reach them.

    (e) Many of our trips take place in destinations where local conditions vary enormously, and the people we deal with on the ground may be less time-conscious or meticulous in planning than ourselves, and while we will do our best to ensure that the holiday goes according to plan, we ask that those who travel with us do so with a spirit of adventure, in a positive frame of mind, and in good humour.

  1. Complaints.
    If the Client has a complaint regarding hotel services the relevant supplier (e.g. the hotelier) should be informed immediately or as soon as possible (in any event no later than 24 hours) of the occurrence of the event giving rise to the complaint. If the supplier cannot resolve the complaint Premier Lanka Voyages must be informed in writing within twenty four (24) hours with the original booking reference and all relevant information.The Client acknowledges that problems can only be resolved if Premier Lanka Voyages and service providers are made aware immediately or as and when they occur. Premier Lanka Voyages regrets that it cannot accept liability in relation to any complaint or claim which is not notified in accordance with this clause.Any disputes arising between Premier Lanka Voyages and the passenger in respect of any complaints remaining unresolved for more than sixty (60) days shall be referred to arbitration by a single arbitrator in accordance with the ICC Rules for Arbitration. The Language of the Arbitration shall be English and the place of Arbitration shall be Colombo, Sri Lanka.
  1. Premier Lanka Voyages liability
    Clients hereby expressly acknowledge that all facilities, services made available and/or recommended by Premier Lanka Voyages and utilised by the Client shall be at the Client’s risk and that Premier Lanka Voyages shall not be responsible for any damage or injury to the Client in this regard.
  1. Insurance
    Premier Lanka Voyages also recommends that Clients obtain travel insurance with full cancellation cover. You must be fully insured for your holiday and must make sure that all of the activities which you will be carrying out are covered by such insurance. This insurance must include adequate cancellation insurance to the value of your holiday, emergency evacuation and repatriation costs in respect of all of your activities. Please note that the travel insurance provided by some credit card providers often only offers the minimum coverage and, whoever your insurer, you should always check for any exclusion of activities that you might be undertaking. In response to public concern, some insurers now offer specific insurance against ancellation, delay and abandonment due to volcanic ash disruption, etc. This can be taken out as an add-on to some travel insurance policies or as stand-alone cover.
  1. Global Support Companies
    Premier Lanka Voyages is supported by approved affiliated companies who provide support services to Premier Lanka Voyages, including in some instances, limited customer care support (“Support Companies”). These Support Companies do not provide an online reservations service and they do not own, control, host, manage or maintain the Premier Lanka Voyages website (or any other website belonging to Premier Lanka Voyages). Premier Lanka Voyages is domiciled only at its office in Sri Lanka and not at the offices of any Support Company around the world. The Support Companies are not authorized to act as Premier Lanka Voyages process or service agents, and customers will also not be able to  make a reservation in or through any of these offices.
  1. Updates
    Our Terms & Conditions are updated from time to time. The terms and conditions which will apply to your holiday are those on our website at the time of booking. There may be additional terms and conditions which apply to our special offers, promotions and discounts from time to time. These will be notified to you at the time of booking, should you inform us that you would like to take advantage of  these special offers, promotions and discounts, we will be delighted to add you to our notifications.
  2. Copies
    A copy of our latest terms and conditions can be viewed on our website www.premierlankavoyages.com  where you can print a copy for your records. By proceeding with any booking, you confirm you have read and agreed to our Terms & Conditions.
